Refund Policy

The principle

Work we have not done yet is refundable. Money already paid onward on your behalf — a state filing fee, an IRS charge, a registry fee — is not, because once submitted it is no longer ours to return.

Everything below is that principle applied to the situations that actually come up.

What a refund is measured against

Every formation package price on this site includes the government filing fee named on the package. The two parts follow different rules. The government fee is refundable in full until the moment we submit it, and not at all afterwards, because the government does not return it to us. Our service fee is refundable in proportion to the work not yet performed.

Standalone services work the same way: the service fee follows this policy, and any third-party cost inside the price follows that third party's own rules once it has been paid onward.

Before anything is filed

If you cancel before we have submitted anything, we refund what you paid, less any third-party cost already incurred on your instructions and less a reasonable charge for work already performed — a name-availability check or preparing your formation documents, for instance.

The initial consultation is free, so cancelling after it costs you nothing.

After a filing is submitted

Once a filing is submitted, the government fee for it is spent and the service fee for that part of the work is earned; neither is refundable. Anything in your package that has not been started is refundable in full, and work that is part-done is charged only for what was actually performed.

If you ask, we will itemize the calculation: what was retained, for which piece of work, and what is coming back.

If a bank declines your application

We resubmit through an alternate banking partner at no additional charge. If no partner can approve you, we will tell you plainly rather than leaving the application open.

Where no partner can approve you, what is refundable depends on how much of the work was completed, and we agree it with you case by case. If this is the risk that concerns you, ask before you buy and we will put our position in writing.

Decisions we do not control

A refusal by a government body, a bank or a marketplace is a decision made by that party against its own criteria. It is not by itself a failure to deliver our service, and it does not entitle you to a refund of work correctly performed.

If the refusal was caused by our error, we correct it at our cost — including paying a re-filing fee where one is required. If it was caused by information you gave us that was wrong or incomplete, the correction and any new government fee are yours.

If the engagement ends early

Either of us may end the engagement in writing. If you end it, this policy determines what is returned. If we end it because we cannot lawfully or practically continue, we refund fees for work not yet performed and hand over the documents you are entitled to.

The exception is work we stop under the lawful-purpose rule in the Terms of Service; fees already paid are retained as those terms describe.

Currency and method

Refunds are issued by the method you paid and in the currency we invoiced. BDT figures shown on this site are indicative conversions; a refund is not adjusted for exchange-rate movement between payment and refund, and charges taken in transit by banks or payment providers are outside our control.

How to ask

Email hello@smartbizmo.com with your name, what you paid for, and roughly when. We respond within five business days and, where a refund is due, issue it within 14 days of agreeing the amount.

Chargebacks

Please talk to us before raising a chargeback. A dispute we hear about first is usually resolved faster than one that arrives through a payment provider.

Your statutory rights

Consumer law where you live may give you refund rights that cannot be excluded by a policy like this one. Nothing here takes those away.
